Agreement Overview
These terms and conditions govern the sale of goods and services by DIY Shutters Pro ("the seller") to you ("the buyer"). By placing an order, you agree to be bound by these terms. These conditions constitute the entire contract between us, unless otherwise agreed in writing.
1 Quotations & Orders
- Quotations: All quotes are invitations to treat, not legal offers. Your purchase order is the offer, and our order acceptance creates the binding contract.
- Pricing: Prices include GST but exclude delivery unless stated otherwise. We reserve the right to alter prices without prior notice before order acceptance.
- Minimum Order: A minimum order charge equivalent to 0.5 square meters applies. Orders smaller than this will be charged at the 0.5sqm rate.
2 Delivery & Risk
Estimates Only
Delivery times are estimates. While we strive for punctuality, we are not liable for delays caused by third-party transport companies.
Inspection Required
You must inspect goods upon arrival. Any damage or non-delivery must be reported in writing within 5 days of receipt.
3 Payment & Retention of Title
Payment Terms
Unless a credit account is approved, all goods must be paid for in full prior to delivery. Overdue accounts may incur interest at 2.5% per month.
Ownership
Goods remain the property of DIY Shutters Pro until full payment has been received. Until title passes, you must store the goods separately and clearly identifiable as our property. We reserve the right to repossess goods if payment is not made.
4 Returns & Liability
Defective Goods
Any defective goods must be returned within 14 days of delivery. We do not accept cancellations for made-to-measure products once the order is agreed and deposit paid.
Limitation of Liability
We are not liable for consequential loss or damage arising from delay or failure to deliver. Our liability is limited to the value of the order. We do not accept responsibility for changes to window surrounds (handles, alarms, tiling) made after the final measure.
5 Product Standards & Tolerances
Our products are crafted to high standards, but as with all building materials, certain tolerances apply:
- Size Tolerance: +/- 2mm per panel is considered acceptable.
- Warp Tolerance: Up to 1mm per 300mm is within standard limits.
- Colour: Minor imperfections not visible from 1 meter under ordinary light are not defects. Natural materials may vary slightly in colour.
Jurisdiction
These contracts are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the Victoria State Courts.
